, as well as in other cases provided for by the legislation of the Russian Federation or an international treaty of the Russian Federation, is carried out at the initiative of the federal executive body in the field of internal affairs or its territorial body, or at the request of a foreign citizen to establish his identity.

Identification of a foreign citizen is carried out on the basis of a decision of the head of the federal executive body in the field of internal affairs or its territorial body in accordance with the procedure determined by this article.

2) conduct appropriate checks, interrogate persons indicated by a foreign citizen as witnesses at the place of residence or place of stay of a foreign citizen, as well as identify him on the basis of witness testimony;
3) use information about foreign citizens contained in the state information system of migration registration;
4) use fingerprint information obtained during state fingerprint registration;
5) send requests to diplomatic missions or consular offices of foreign states in the Russian Federation, international organizations.

5. Questioning of persons indicated by a foreign citizen as witnesses is carried out by an employee of the territorial body of the federal executive body in the field of internal affairs. The results of the interview are documented in the minutes of the interview of the witness, which indicates the place and time of the interview, the position, last name, first name, patronymic of the person who conducted the interview, the personal data of the witness, as well as the identity document of the witness.

6. The record of the interrogation of a witness shall be presented for familiarization to the witness who participated in the interrogation. The witness may enter into the protocol remarks on its addition and clarification, which are certified by his signature. The protocol is signed by the employee of the territorial body of the federal executive body in the field of internal affairs who compiled it and the witness who participated in the interrogation.
If the witness refuses to sign the protocol, an officer of the territorial body of the federal executive body in charge of internal affairs shall make an appropriate entry in the protocol and certify it with his signature.

8. A foreign citizen is presented for identification together with other persons, if possible, outwardly similar to him. The total number of persons presented for identification must be at least three. Before the beginning of the identification, a foreign citizen is invited to take any place among the persons presented for identification, about which a corresponding entry is made in the protocol of identification.
If it is impossible to identify a foreign citizen, identification can be carried out directly by his photograph, presented simultaneously with photographs of other persons, if possible outwardly similar to the person being identified. The number of photographs must be at least three. If the identifying person pointed to one of the persons presented for identification or to one of the photographs, then he is invited to explain by what signs or features he identified this person, and also to indicate the surname, name and patronymic of the identified person.
9. Based on the results of the identification, an identification protocol is drawn up, which indicates the place and date of the identification, the position, surname and initials of the person who compiled the protocol, the surnames, names, patronymics of the persons participating in the identification, and, if necessary, the address of their place of residence (place of stay ) and other information about them.

The protocol of identification is presented for familiarization to all persons participating in the identification. The said persons may enter into the protocol remarks on its addition and clarification, which must be certified by their signatures.
11. The identification protocol shall be signed by the employee of the territorial body of the federal executive body in charge of internal affairs who drew it up, as well as by the persons participating in the identification. If the person participating in the identification process refuses to sign the protocol, an employee of the territorial body of the federal executive body in charge of internal affairs shall make an appropriate entry in the protocol and certify it with his signature.

12. Based on the results of the inspections, questioning of witnesses and identification by the territorial body of the federal executive body in the field of internal affairs, a conclusion is drawn up on establishing the identity of a foreign citizen, which is signed by the head of the specified territorial body.
The originals of documents submitted by a foreign citizen for the purpose of carrying out the identification procedure shall be returned to the foreign citizen. A copy of the conclusion of the territorial body of the federal executive body in the field of internal affairs on establishing the identity of a foreign citizen is handed over (sent) to this foreign citizen within three working days from the date of drawing up this conclusion.
A foreign citizen who does not have valid identity documents, upon establishing that this person has the citizenship of a foreign state or upon establishing a state ready to accept a stateless person, is issued a certificate of the established form with a photograph to follow to the diplomatic mission of the corresponding foreign state in the Russian Federation .
The application form for issuing a certificate for going to the diplomatic representation of a foreign state in the Russian Federation, the form of such a certificate and the procedure for issuing it are approved by the federal executive body in the field of internal affairs.
